In 2004 the DA of Los Angeles tried to get some personnel files from the Archdiocese of Los Angeles. Mahony refused and claimed these files were the equivalent of confessional matter and were protected by what he called the "Formation Privilege."

Doyle was asked to submit a declaration which demonstrated from official sources that there is no such thing. This is his declaration along with a commentary added July 2, 2008. This document is important because it was a key element that helped to defeat Mahony's efforts. He lost at every level from the local court to the US Supreme Court. This document is one of many he has prepared for cases over the years.
